1. Agreement to Terms

By accessing or using TableMenu's platform, website, mobile applications, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

TableMenu is operated by TableMenu Ltd., a company registered in Ghana. These Terms govern your use of our restaurant discovery, reservation, ordering, and management platform.

2. Description of Service

TableMenu provides:

  • For Diners: Restaurant discovery, table reservations, online ordering, menu browsing, and payment processing
  • For Restaurants: Point of sale systems, order management, reservation management, menu management, kitchen display systems, staff management, analytics, and customer relationship tools

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use.

3.3 Account Types

  • Diner Accounts: For individuals making reservations and orders
  • Restaurant Accounts: For restaurant owners and managers operating their business on our platform
  • Staff Accounts: For restaurant employees with delegated access

4. Restaurant Terms

4.1 Subscription Plans

Restaurants subscribe to TableMenu on a monthly basis. Plans include Basic, Standard, and Professional tiers with varying features and pricing. Subscription fees are billed monthly in advance and are non-refundable except as required by law.

4.2 Restaurant Responsibilities

Restaurants using TableMenu agree to:

  • Maintain accurate menu information including prices, descriptions, and availability
  • Honor all reservations made through the platform
  • Process orders promptly and maintain food quality standards
  • Comply with all applicable food safety and business regulations
  • Respond to customer inquiries and complaints in a timely manner

4.3 Commission and Fees

Transaction fees may apply to orders processed through the platform. Fee schedules are provided in your subscription agreement and may be updated with 30 days notice.

5. Diner Terms

5.1 Reservations

When you make a reservation through TableMenu, you agree to honor that reservation or cancel within the restaurant's cancellation policy window. Repeated no-shows may result in account restrictions.

5.2 Orders and Payments

All payments are processed securely through our payment partners. By placing an order, you agree to pay all charges including food costs, applicable taxes, service fees, and tips.

5.3 Reviews and Content

You may submit reviews, ratings, and other content. You grant TableMenu a non-exclusive, royalty-free license to use, display, and distribute such content. Reviews must be honest, accurate, and not contain offensive or defamatory content.

6. Payment Processing

TableMenu uses third-party payment processors including Paystack and mobile money providers. By using our payment features, you also agree to the terms of our payment partners. We do not store complete credit card information on our servers.

Refunds are processed according to the restaurant's refund policy. For disputes, contact the restaurant first, then TableMenu support if unresolved.

7. Prohibited Activities

You agree not to:

  • Use the Service for any unlawful purpose
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems to access the Service without permission
  • Submit false reviews or fraudulent orders
  • Harass restaurant staff or other users
  • Use the platform for any form of spam or unsolicited advertising

8. Intellectual Property

The Service and its original content, features, and functionality are owned by TableMenu and are protected by international copyright, trademark, and other intellectual property laws.

Restaurant content (menus, images, descriptions) remains the property of the respective restaurants, with a license granted to TableMenu for display on the platform.

9. Limitation of Liability

TableMenu acts as an intermediary platform connecting diners with restaurants. We are not responsible for the quality of food, service, or dining experience at partner restaurants.

To the maximum extent permitted by law, TableMenu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, restaurants, us, or third parties, or for any other reason at our sole discretion.

Restaurants may cancel their subscription at any time. Access will continue until the end of the current billing period.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Ghana.
